Background
A vulnerable client contacted us after their vehicle was clamped by enforcement agents despite displaying a valid Blue Badge.
Challenge
We believed the vehicle should have been treated as exempt from enforcement action because the valid Blue Badge indicated that it was used by a disabled person. However, the enforcement agent disputed this interpretation and maintained that the clamping was lawful.
Our Approach
To seek clarification and ensure the correct application of enforcement standards, we escalated the matter to the Enforcement Conduct Board (ECB).
Outcome
The ECB agreed with our position, confirming that a vehicle displaying a valid Blue Badge should be treated as exempt goods in these circumstances. Following this decision, the enforcement agent acknowledged the error, apologised, and updated their practices to ensure similar situations are handled correctly in the future.
